Translation notice

In the event of discrepancies between translated versions of this Privacy Policy, the English version shall prevail.

Introduction

This Privacy Policy explains how Aleksandr Vasilenko autónomo (AirQode) ("we", "us") processes personal data when you use QODE ERP, related websites, and supporting services (together, the "Services"), including access via authorized project domains.

QODE ERP currently provides services primarily within the European Economic Area (EEA) and operates in accordance with GDPR and applicable EU/Spanish data protection legislation.

Our activities include software development, ERP systems, AI-assisted business software, workflow automation, SaaS platforms, digital infrastructure, IT consulting, and related information technology services — consistent with editing and programming of computer software and IT consulting.

Controller & processor roles

Individual users & visitors

For personal data processed in connection with your account, marketing subscription, or general use of our websites, Aleksandr Vasilenko autónomo (AirQode) typically acts as an independent controller.

Enterprise / Workspace customers

For Workspace-hosted business data that your organization enters into QODE ERP, your organization is typically the controller for that data, and Aleksandr Vasilenko autónomo (AirQode) acts as a processor providing the platform, hosting, and agreed processing on your instructions. The specifics are governed by your agreement and, where applicable, a Data Processing Agreement (DPA).

Categories of data & purposes

Depending on how you use the Services, we may process categories such as:

  • Identity and contact data (e.g., name, email, phone, business identifiers).
  • Account and authentication data (e.g., credentials, session identifiers, security logs).
  • Workspace business data that customers configure in QODE ERP (for example products, orders, partners) to provide the contracted service.
  • Technical and service data (e.g., IP address, device/browser metadata, diagnostics, timestamps) for security, reliability, and support.
  • Billing and payment-related records where payment features are enabled.

Legal bases (GDPR)

Where GDPR applies, we rely on appropriate legal bases such as:

  • Performance of a contract (providing the Services you request).
  • Legitimate interests (e.g., securing the platform, preventing abuse, improving reliability), balanced against your rights.
  • Consent, where required (for example certain cookies or marketing communications, where applicable).
  • Legal obligations (e.g., tax, accounting, or lawful requests from competent authorities, subject to applicable law).

International transfers

We aim to process and store personal data primarily within the EEA. If any processing or hosting involves a transfer outside the EEA, we use appropriate safeguards under Article 46 GDPR (such as standard contractual clauses), an adequacy decision where available, or other permitted mechanisms. We do not list specific countries here unless required for transparency in a particular deployment.

Subprocessors registry

We use carefully selected service providers to operate QODE ERP. The table below summarizes current infrastructure and payment-related providers. It is maintained from configuration and may be updated as our operations evolve.

Where payment processing is enabled, Aleksandr Vasilenko autónomo (AirQode) may use Stripe as an independent payment processor and/or subprocessor for billing, invoicing and payment-related services. Stripe’s processing locations depend on your transaction characteristics and Stripe’s configuration — data is not represented here as permanently confined to a single country.

AI-assisted processing

Certain QODE ERP features may use AI-assisted processing where enabled, for automation, analytics, classification, or workflow optimization. Such features are designed to support human decision-making and are not intended to produce legally significant effects for individuals solely by automated means without human involvement, where such involvement is required by applicable law.

Corporate customers remain responsible for ensuring they have a lawful basis and appropriate controls for any personal or sensitive data they choose to upload or process through the platform.

Cookies & similar technologies

We use cookies and similar technologies in line with EU requirements:

  • Strictly necessary cookies: required to operate the service (authentication, security, load balancing). These do not require consent under the ePrivacy framework.
  • Functional, analytics, or marketing cookies: used only where you have given consent through the applicable cookie preference mechanism in the product or website, where required.

Marketing cookies are not enabled by default; they may be enabled where applicable based on your choices and product configuration.

Use our Cookie Policy for the full inventory, or open to manage categories.

Under GDPR (where applicable), you may have the following rights subject to conditions and exceptions:

Request access to your personal data and, where applicable, receive a copy in a structured, commonly used format.

Rectification & erasure

Request correction of inaccurate data or deletion, subject to legal retention requirements.

For enterprise customers, Aleksandr Vasilenko autónomo (AirQode) may enter into a separate Data Processing Agreement (DPA) that describes processing instructions, technical and organizational measures, subprocessors, and assistance for data subject requests. The DPA forms part of or supplements your commercial agreement.

A DPA may be available upon request for qualified enterprise deployments.

Additional regional disclosures may be published as QODE ERP expands to new jurisdictions. Until an addendum is published for a specific country or region, this policy does not claim comprehensive compliance with that region’s local privacy laws for services not yet formally launched there.
